Addressing Feelings of Guilt or Stigma With Bankruptcy
Robert A. Gilmore, Esq.,
I understand that, even with the best of intentions, good people people can find themselves on hard times and in financial duress. Everyone can and does make mistakes and sometimes things just happen that are beyond your control. You may have purchased a home or made investments, only to have the housing market fall out from under you, saddling you with high mortgage payments. Or you may have lost your job or business revenue and have relied on credit cards, title loans, payday loans, or other personal loans to help get you through these difficult economic times with the intention of paying everything back when times get better, only to find the situation getting worse and worse.
In my experience, the overwhelming majority of people who file for Bankruptcy Relief are honest hard-working people and feel bad about not being able to pay all of their bills. Some people feel guilty for filing bankruptcy.
You should not feel bad or guilty for filing bankruptcy relief. The bankruptcy laws were passed to help you, and is not in place to shame or embarrass you.
It is also important to realize that Bankruptcy is NOT the end of the word. You can rebuild your credit after filing bankruptcy, often faster than you could if you do not file for relief (depending on your particular circumstances).
If you are not able to provide for your family's financial needs and pay your other debts, your family's needs should come first. Your agreements to pay your credit cards, payday loans, or other debts should not come before your obligations to your family. In this situation, a fresh financial start is likely in your and your family's best interest.
You are not alone in seeking relief. The current economic recession is witness to the fact that the world's financial giants, the smartest investment and money managers, and our largest most succesful companies needed a fresh start and relief under bankruptcy law to survive and become productive again.
Keep in mind, credit card companies don't care if you file bankruptcy because they take in substantially more money on excessive interest rates, late fees, and penalties than they loan out. They are undertaking a calculated business plan designed to maximize their profits. If you review your payment history, you may be surprised to find that you have paid the actual amount borrowed back when you include how much interest and fees you have paid.
Nothing in the bankruptcy laws prevent you from repaying your discharged debts when you are back on your feet financially and are able to make payments.
The stress that accompanies financial problems is probably having a severe adverse affect on your life, your friends, and your family. For some people, this stress can manifest itself emotionally and physically. You can regain some peace of mind and a feeling that you have some room to breathe.
Regardless of your specific situation, my staff and I will work to help you find the available debt relief options, so you can make an informed decision.
